Howe did not know that the driver, Oney Knight, was an escaped murderer from the Oklahoma State Penitentiary. Howe approached the car on foot. As he reached the car, Knight stepped out and shot the officer twice. Howe’s partner, John Ingals, fired at the escaping fugitive but failed to stop him.
